A mockery???

Fon Doh Gah Gwanyin III, earlier convicted in 1996 for the murder of John Kohtem, has been set free by the Northwest Court of Appeal. He was freed Tuesday, January 25, alongside nine others who were sentenced with him and were serving 15-year jail terms each at the Ndop Production Prison.

A three-man panel of Judges led by Chief Justice L. F. Jani set aside the earlier judgment by the Ndop High Court that had slammed various sentences on Fon Doh and nine other accused persons. The two other Judges who delivered Tuesday’s ruling were Justices I.T. Nko and B.E. Fondjock. The Appeal Court based its argument on the fact that the panel that passed the sentence jailing the Balikumbat Fon and a CPDM former MP was not properly constituted.
Lawyers defending Fon Doh had argued that Justice Damian Ambe Suh, who presided at the Ndop High Court, was the Vice President of the Northwest Court of Appeal and Justice Eni Mokube, another member of the panel, was President of the High Court of Donga-Mantung. Thus, it was argued that they were both of a different jurisdiction, but that they were brought together and joined Justice Beatrice Tayong to handle the matter.
According to them, when a court is not competent, everythin it does is a nullity.The Court of Appeal therefore based its judgement on the composition of the Ndop High Court that sentenced the Fon and not on the substance of the murder.

The court did not go into the merits of the case to find out whether or not Fon Doh and the other nine persons murdered Kohtem. This further means that the Kohtem family can file the matter anew.

What does this all even mean? Jurisdiction quoi? I smell a rat, I do because I am sure there is a political motive behind this, especially with the elections coming up soon.
